Terms of Service

These Terms of Service (“Terms”) govern your use of the Athivo mobile application and website at athivo.co.uk(collectively, “the Service”). By creating an account, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Athivo is a platform that helps people find workout partners, create shared training commitments, and track their reliability over time. We provide tools for scheduling, messaging, groups, and accountability analytics.

2. Eligibility

You must be at least 16 years old to use Athivo. By creating an account you confirm that you meet this requirement. We reserve the right to terminate accounts that we reasonably believe are held by users under this age.

3. Your account

• You are responsible for keeping your login credentials confidential.
• You must provide accurate and current information in your profile.
• You may not create accounts on behalf of others or impersonate any person.
• You are responsible for all activity that occurs under your account.

4. Acceptable use

When using Athivo you agree not to:

• Post false, misleading, or deceptive content
• Harass, abuse, or threaten other users
• Use the Service for any unlawful purpose
• Scrape, crawl, or automate access to the platform
• Attempt to access systems or data you are not authorised to access
• Use another user’s data without their explicit consent
• Create fake accountability records or manipulate scores

We may suspend or terminate any account that violates these rules without notice.

5. Commitments and accountability

When you create or accept a training commitment, you are making an agreement with another user — not with Athivo. We facilitate the connection and track attendance, but we are not responsible for the conduct of other users, the safety of any training arrangement, or any harm that arises from meeting another user in person.

Always exercise common sense and take reasonable precautions when meeting people you have connected with through the app.

6. Athivo Plus subscription

• Athivo Plus costs £9.99 per month and grants access to unlimited matches, unlimited commitments, advanced filters, accountability reports, priority visibility, and other premium features.
• Subscriptions are billed monthly through the Apple App Store or Google Play Store. Your subscription renews automatically unless cancelled at least 24 hours before the renewal date.
• To cancel, use the subscription management settings in your App Store or Google Play account. We cannot process cancellations directly.
• Refunds are governed by Apple’s and Google’s respective refund policies. We do not offer refunds for unused subscription periods.
• We reserve the right to change pricing with reasonable prior notice.

7. Content

You retain ownership of content you upload (profile photos, bio, messages). By uploading content, you grant us a non-exclusive, worldwide, royalty-free licence to use that content solely to operate and improve the Service.

You must not upload content that is illegal, infringing, sexually explicit, or discriminatory. We may remove content that violates these Terms without notice.

8. Intellectual property

All rights in the Athivo name, logo, app, and website belong to us. You may not use our branding without written permission.

9. Limitation of liability

To the maximum extent permitted by law, Athivo is provided “as is” without warranties of any kind. We are not liable for indirect, incidental, or consequential losses arising from your use of the Service, including losses arising from interactions with other users.

Our total liability to you for any claim shall not exceed the amount you paid us in the three months preceding the claim.

10. Termination

• You may delete your account at any time from the Profile tab in the app.
• We may suspend or terminate accounts that violate these Terms.
• Upon termination, your personal data is deleted within 30 days in accordance with our Privacy Policy.

11. Changes to these Terms

We may update these Terms from time to time. We will notify you of material changes via in-app notice or email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.

12. Governing law

These Terms are governed by the law of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
